General
1. Sponsor/Promoter
1.1. The sponsor/promoter of all competitions hosted on Coolcompetitions.uk or its Mobile Applications is coolcompetitions.uk referred to as
‘Coolcompetitions.uk’, ‘we’ or ‘us’.
2. Laws & Regulations
2.1. Coolcompetitions.uk operate prize competitions that are free from regulation under the Gambling Act 2005;
2.2. Although the term ‘raffle’ is often referred to on our website, this is for marketing and SEO purposes only and due to the fact that each entrant is required to answer a question or puzzle upon entering, all competitions hosted on our platform are therefore legally considered ‘Prize Competitions’ and not raffles;
2.3. For further information about the laws and regulations on raffles and prize competitions, please visit www.gamblingcommission.gov.uk.
3. Official Partners
3.1. Although Coolcompetitions.uk is the official sponsor of each competition; some competitions have an ‘Official Partner’ that is responsible for providing the associated prizes for the relevant competitions;
3.2. Official Partners are contractually obliged to provide the relevant prizes to the winners, whilst all related financial obligations are between
Coolcompetitions.uk and the Official Partners;
3.3. In the absence of an Official Partner, Coolcompetitions.uk is responsible for providing the associated prizes for the relevant competitions;
3.4. Official Partners can also be referred to as ‘Hosts’.
4. Hosting
4.1. Only users with a verified email address and mobile number can host a raffle or competition on our platform;
4.2. Hosts are responsible for providing the following information:
a. Writing the raffle title;
b. Writing the full description;
c. Providing 1 to 8 images;
d. Choosing a delivery/collection option;
e. Choosing a ticket price;
f. Choosing the total number of tickets to be issued;
g. Choosing an end-date;
h. Choosing a charitable donation;
i. Choosing an entry question or puzzle;
4.3. By publishing a raffle, the Host enters into a sale/purchase agreement with Coolcompetitions.uk and are contractually obliged to sell their prize to Coolcompetitions.uk under the following terms and conditions;
a. Coolcompetitions.uk agrees to purchase the prize for a total price amounting to the described price per ticket multiplied by the total number of
tickets sold by the draw date;
b. Coolcompetitions.uk commission and any charitable donation will be deducted from the total price mentioned in 4.3(a);
c. Coolcompetitions.uk is obliged to pay the Host for the prize within 30 days of the draw date, or within 48 hours of the winner pressing the ‘accept’ button located on the winning ticket, (whichever comes sooner);
d. The Host is obliged to communicate with the winner to arrange delivery or collection of the prize;
e. The host is obliged to take all necessary steps to ensure safe exchange of the prize and is expected to obtain all relevant shipment/collection or delivery receipts in case proof is needed in the event of a dispute;
f. If the Host fails to provide the prize to the winner within 21 days of the draw date, the contract between Coolcompetitions.uk and the Host is deemed null and void and is terminated with immediate effect;
g. In the event of a dispute, Coolcompetitions.uk reserves the right to investigate the circumstances surrounding the dispute and:
i. If the dispute is awarded in favor of the Host, Coolcompetitions.uk must pay the Host within 7 working days of the dispute being awarded.
ii. If the dispute is awarded in favor of the winner, Coolcompetitions.uk has no obligation to pay the host and the contract between Coolcompetitions.uk and the Host is terminated with immediate effect.
iii. If the dispute is awarded in favor of the winner, then as per the Coolcompetitions.uk Guarantee, the winner will receive compensation amounting to 75% of the total ticket revenue generated for that raffle. If a raffle has multiple prizes, then any winner that is awarded a dispute will receive a proportionate share of the 75% compensation.
4.4. Coolcompetitions.uk reserves the right to cancel any competition at any time without reason;
4.5. Prohibited items may not be offered as prizes on Coolcompetitions.uk ;
4.6. Offering a cash payment, bank transfer, gift card or share of the ticket revenue as an alternative to providing the advertised prize is not
permitted;
4.7. Any publishing or hosting fees paid to Coolcompetitions.uk are non-refundable.
5. Information
5.1. The following competition information is public and accessible by anyone with or without a Coolcompetitions.uk account:
a. Title;
b. Summary;
c. Prize title;
d. Prize description;
e. Prize delivery/collection details;
f. Images;
g. Video;
h. Ticket price;
i. Total number of tickets;
j. End-date.
5.2. The following user information is restricted to the hosts and entrants of their competition only:
a. Entrant names;
b. Entrant profile image (if applicable);
c. Number of tickets held by each entrant.
5.3. The following user information is restricted to competition hosts only:
a. Entrants email address;
b. Winners Facebook ID;
c. Winners telephone number (if applicable).
6. Entry
6.1. Only Registered Users of Coolcompetitions.uk are eligible to enter competitions hosted on Coolcompetitions.uk or Coolcompetitions.uk;
6.2. In order to enter a ‘pay to enter’ competition, each entrant must:
a. Submit their answer to the respective question or puzzle;
b. Pay for the number of tickets they wish to purchase using Coolcompetitions.uk Credit or Credit/Debit card.
7. Questions & Puzzles
7.1. Each entrant must submit their answer to the respective question or puzzle upon entering each competition;
7.2. Each competition has a different question or puzzle;
7.3. Each question or puzzle consists of 4 multiple choice answers with only 1 answer being correct;
8. Credit
8.1. Credit can be purchased via Bank Transfer or via Credit/Debit card through any of the payment options;
8.2. Credit is strictly non-refundable;
9. Tickets
9.1. Details of each entered as well as a list of all purchased tickets can be found in the app under ‘Your Tickets’;
9.2. Tickets are displayed as follows:
a. Light green tickets with centered ticket numbers represent tickets for competitions that have not yet ended or been drawn;
b. Light red tickets with a sad face represent loosing tickets for competitions that have already ended;
c. Light green tickets labeled ‘refunded’ represent tickets that have been refunded due to not enough tickets being sold before the end-date;
d. Dark green tickets that have a ‘claim’ button represent winning tickets that require the winner to accept or dispute the prize within 21 days of the draw date;
e. Dark green tickets labeled ‘accepted’ represent winning tickets that have been accepted;
f. Dark red tickets labeled ‘disputed’ represent winning tickets that have been disputed.
10. Winner Selection
10.1. Each ticket that contains the correct answer to the respective question or puzzle is entered into the draw with the winner selected at random by Coolcompetitions.uk automated system.
11. Draw Notifications
11.1. The competition host and all entrants will be notified that a draw has been made via the email address associated with their Coolcompetitions.uk account immediately after the draw has been made.
11.2. The email notification sent to the entrants includes a link and a request for them to check their tickets on our platform.
11.3. The email notification sent to the hosts includes instructions and the winners name, email address, mobile number (if provided), Facebook ID (if provided) and ticket information.
12. Delivery/Collection
12.1. Delivery of the prize is not included unless specifically stated;
12.2. If collection of the prize is possible then the host and winner must communicate directly to arrange and agree on a suitable date and time for both parties;
13. Acceptance/Dispute
13.1. Winning ticket holders have 21 days from the End-Date’ to either ‘Accept’ or ‘Dispute’ the prize;
13.2. Collection/Delivery of the prize should be concluded prior to the winning ticket holder ‘accepting’ or ‘rejecting’ the prize;
13.3. Pressing ‘Accept’ or ‘Reject’ means:
a. ‘Accept’ – confirms that the prize is as advertised and possession of it has been taken. At that moment all net-proceeds from ticket sales will be credited to the Coolcompetitions.uk host’s account and it is considered closed;
b. ‘Dispute’ – confirms that the prize is not as advertised, or that possession of it has not been taken. At that moment status will be changed to
‘Dispute’ and will be investigated by a member of our Disputes Team who will decide whether the proceeds from tickets sales will be transferred to the Coolcompetitions.uk host or refunded back to the ticket purchasers;
13.4. If the winner neither ‘accepts’ nor ‘disputes’ the prize within 21 days of the ‘End-Date’, we reserve the right to withdraw the prize from the winner and select a replacement winner at random.
14. Disputes
14.1. If a competition is disputed it will be immediately investigated by a member of our Disputes Team who will decide whether the dispute is awarded in favor of the host or the winner(s);
Free Cash Lottery
15. Entry
15.1. Only Registered Users of Coolcompetitions.uk are eligible to enter free cash lottery hosted on Coolcompetitions.uk;
15.2. Coolcompetitions.uk Free Cash lottery can only be entered from the mobile app;
15.3. Users can only sign in to Coolcompetitions.uk using any of the given possibilities;
15.4. In order to enter Coolcompetitions.uk Free Cash Lottery, each entrant must do one of the following:
a. Watch 2 video ads all the way to the end before receiving one free ticket;
b. Complete an offer displayed on the offerwall to receive the number of free tickets indicated next to the offer;
15.5. Users can choose only 1 entry option per day (either 15.4a or 15.4b);
15.6. If users try to complete multiple offers in one day, only the free tickets from the 1st completed offer will be counted;
15.7. Each free ticket will be used for the Free Cash Lottery that is live at the time that the tickets have been issued;
15.8. Sponsored video ads are supplied by third-party ad networks and we are therefore not responsible or liable for any content served to our users;
15.9. We accept no liability or responsibility for technical issues relating to advertising that may result in the loss of ads being displayed, app crashes or disputed lottery ticket issues;
15.10. The Ad Network controls what ads are served and in which locations. They also reserve the right to not serve ads to specific users or users located in specific locations.
15.11. Offers are supplied by third-party ad networks and we are therefore not responsible or liable for any offers served to our users;
15.12. The ad network is responsible for notifying us after users successfully complete each offer;
15.13. Free lottery tickets are only issued after we have received notifications from the ad networks confirming that users have successfully completed offers in full;
15.14. Most notifications take up to 15 minutes to be received which means that issuing free lottery tickets can also be delayed by the same time;
15.15. Details of the required action are clearly displayed on each offer. For example “Finish Tutorial”;
15.16. The number of free lottery tickets issued for each offer varies and is subject to change without notice;
15.17. We accept no liability or responsibility for technical issues relating to offers that may result in the loss of offers being displayed, app crashes or disputed lottery ticket issues;
15.18. The Ad Network controls what offers are served and in which locations. They also reserve the right to not serve offers to specific users or users located in specific locations.
15.19. After entering, users can choose to get additional tickets by sharing the link;
15.20. Referring people to join Coolcompetitions.uk:
a. Pressing the ‘Invite to get 100 extra tickets’ button will prompt users to share a unique Invite to Free Lottery link via any of the applications
installed on the users device;
b. Each time a new user proceeds to sign in the new user is automatically registered in our system as a lottery referral of the respective referrer;
c. Each referrer is notified of new referrals via Push Notifications and in-app alerts immediately after the referred user signs into the app for the
first time;
d. The referrer receives 100 free lottery tickets for each referred user immediately after the referred user signs into the app for the first time;
e. If a referral wins any amount on our Free Lottery then the referrer wins £1 multiplied by the total number of their referrals that entered that draw;
f. The referrer must have entered the draw in order for them to ‘win if their referral wins’;
g. The total amount a referrer can win as a result of referrals winning our Free Lottery is capped at a maximum of £100.
16. Tickets
16.1. Details of each entry as well as a list of all free tickets can be found in the app under ‘Your Tickets’;
16.2. Free entry tickets are displayed as follows:
a. Light green tickets with centered ticket numbers represent tickets for competitions that have not yet ended or been drawn;
b. Light red tickets with a sad face represent loosing tickets for competitions that have already ended;
c. Dark green tickets that have a ‘claim + timer’ button represent winning tickets that require the winner to complete the claim by submitting their
rating & review within the time frame displayed on the ticket;
d. Dark green tickets that have a ‘review’ button represent winning tickets that require the winner to provide a rating and review;
e. Dark green tickets labeled ‘Claimed’ represent winning tickets that have been claimed;
f. Dark red tickets labeled ‘unclaimed’ represent winning tickets that have not been claimed within the allocated time frame;
17. Winner Selection
17.1. Each ticket for a free entry competition will be entered into a draw with the winners being selected randomly by Coolcompetitions.uk automated system.
18. Winner Notifications
18.1. Winners will be notified immediately after the draw;
18.2. Winners will be notified via Push Notifications within the app (if they have enabled them for Coolcompetitions.uk and have an internet connection);
18.3. Winning tickets can also be located within the app under ‘Your Tickets’.
19. Claiming
19.1. Winners are responsible for checking the app to see if they have won a prize and all users are able to check the status of their tickets on the ‘Your Tickets’ screen at any time;
19.2. Winners must claim their prize within the time frame indicated on the winning ticket which is always a minimum of 72 hours from the draw date;
19.3. If a winner does not claim their prize within the allocated timeframe then the prize is no longer available to claim.
20. Transfer/Withdraw
20.1. Monetary prizes won in the Free Draw are automatically credited to the winners temporary holdings account immediately after the draw has ended;
20.2. The total amount available for transfer/withdrawal appears under the heading ‘FREE LOTTERY WINNINGS’ on the My Account screen;
20.3. The user can automatically transfer the amount to their Coolcompetitions.uk Account balance;
20.4. A value displayed in brackets indicates that the amount cannot be withdrawn or transferred until the winner has completed their rating and review;
20.5. A pending amount will be automatically removed if the winner does not provide a rating or review within the allocated time frame.
General
21. Property Competitions
21.1. In relation to property competitions, both hosts and winners will receive further terms and conditions (issued by Coolcompetitions.uk) to co-ordinate
the orderly transfer of the property;
21.2. The property transfer may take up to sixty days from the competition end-date;
21.3. The hosts and winners will be required to instruct independent lawyers to assist them with the property transfer and their names and contact details
will be provided by Coolcompetitions.uk.
22. Charities
22.1. Some competitions have a Charity badge attached to them, which indicates that all or part of the proceeds from ticket sales will go towards a good cause;
22.2. Next to each charity badge is a percentage that indicates the proportion of revenue from ticket sales that will be donated to charity;
22.3. Users can press the charity badge to view details on which charity benefits;
22.4. Only official Registered Charities can be included in our database.
22.5. All charity payments are made directly by us on behalf of the host.
23. Free Credit
23.1. Users can get Free Credit to use within the app by watching sponsored video ads, completing offers and/or by referring people;
23.2. Sponsored video ads:
a. Advertising is supplied by a third-party ad network and we are therefore not responsible or liable for any content served to our users;
b. The amount of free credit issued for each ad view can change from user to user and without notice;
c. We accept no liability or responsibility for technical issues relating to advertising that may result in the loss of ads being displayed, app crashes or disputed credit issues;
d. The Ad Network controls what ads are served and in which locations. They also reserve the right to not serve ads to specific users or users located in specific locations.
23.3. Completing offers:
a. The offers displayed on the ‘Offer Wall’ require users to complete an offer supplied by a third-party company or application in order to receive
their free credit;
b. The free credit is given only after the user has completed the offer in full;
c. Details of the required action are clearly displayed on each offer. For example “Install and RUN” or “Install & Finish Tutorial”;
d. The free credit issued for each offer varies and is subject to change without notice;
e. We accept no liability or responsibility for technical issues relating to offers that may result in the loss of offers being displayed, app crashes
or disputed credit issues;
f. The Ad Network controls what offers are served and in which locations. They also reserve the right to not serve offers to specific users or users located in specific locations.
23.4. Referring people:
a. Each time a new user joins Coolcompetitions.uk after using a Referral code, that user is automatically registered in our system as a referral of the respective referrer;
b. Each referrer is notified of new referrals via Push Notifications and in-app alerts immediately after the referred user signs into the app for the
first time;
c. Free credit for each referred user is added to the referrers Coolcompetitions.uk account immediately after the referred user signs into the app for the first time.
d. In order to be registered as a referred user a Referral Code must be entered when signing into the app for the first time, or the user must complete the registration process after clicking the link contained within any post.
24. Miscellaneous
24.1. By entering any competition hosted on Coolcompetitions.uk, the entrant indicates his/her agreement to be bound by these terms and conditions;
24.2. These Terms and Conditions are governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of the United Kingdom;
24.3. Winners of competitions permit Coolcompetitions.uk to use of their public profile information (including their name, location, age, profile image and Facebook friends), as well as competition and prize information for any publicity material should so desired. Any personal data relating to the winner or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent;
24.4. In the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the our control, we reserve the right to cancel or amend the competition and these terms and conditions without notice. Any changes to the competition will be notified to entrants as soon as possible;
24.5. Neither Contract Partner shall be liable for any delay or failure in performing any of its obligations hereunder, if such delay or failure is, either wholly or partly, due to force majeure conditions such as floods, earthquakes or other acts of God, or any acts of any governmental body or public enemy, wars, riots, embargoes, epidemics, fires, major internet breakdown, mechanical breakdowns, lack of necessary utilities, labor unrest, transport problems or any other causes, circumstances or contingencies beyond the control of such Party (“Force Majeure Event”);
24.6. We reserve the right to alter these Terms and Conditions at any time. Where alterations constitute a material change, users and hosts will be notified through the e-mail associated with their account. What constitutes a material change shall be determined by us at our sole discretion, in good faith, using common sense.
24.7. We reserve the right to force forfeiture of a username for any reason, including but not limited to, that the username violates a third party’s
intellectual property rights, may mislead others or becomes inactive.
24.8. Any user or host, in using the service provided by Coolcompetitions.uk, accepts full responsibility for ensuring their chosen username and any content hosted on our platform does not infringe a third party’s intellectual property rights, including but not limited to, the infringement of trademarks.
24.9. This promotion is in no way sponsored, endorsed or administered by, or associated with, Apple Inc., Facebook, Twitter or any other Social Network. You are providing your information to Coolcompetitions.uk Limited and not to any other party. The information provided would be used in conjunction with this Privacy Policy found.
